JIMI Terms of Service

Thank you for your interest in our products and services. These Terms of Service (the “Agreement”) are a legally binding agreement between JIMI (JIMI PTE. LTD. and its relative companies are collectively referred to herein as “JIMI”, “we” or “us”) and you (“you” or “User”) . This Agreement governs your use of or access to products and services provided by JIMI, including but not limited to game(s) and/or applications for mobile devices and PC platforms, web applications accessible on third-party social networking services, online sites, web forums or messaging boards in applications and sites provided by JIMI (collectively the “JIMI Services”).

YOU SHOULD CAREFULLY READ THIS AGREEMENT AND OTHER SERVICE REGULATIONS PROVIDED BY JIMI (INCLUDING BUT NOT LIMITED TO PRIVACY POLICY AND OTHER REGULATIONS OR RULES STATED IN JIMI SERVICES) BEFORE INSTALLING OR USING JIMI SERVICES. IF YOU DO NOT AGREE WITH ALL OF THE TERMS OF THIS AGREEMENT, YOU MAY NOT INSTALL OR OTHERWISE ACCESS JIMI SERVICES. IF YOU AGREE THIS AGREEMENT THROUGH CLICKING ON THE AND/OR ACTUALLY ACCESS OR USE JIMI SERVICES BY DOWNLOADING OR POSTING ANY CONTENT ON OR THROUGH JIMI SERVICES, IT WILL BE DEEMED YOU HAVE READ, FULLY UNDERSTOOD AND AGREED TO ACCEPT ALL THE TERMS OF THIS AGREEMENT AND OTHER SERVICE REGULATIONS PROVIDED BY JIMI.

SPECIAL NOTE FOR MINORS, PARENTS AND GUARDIANS: YOU AGREE THAT IF YOU ARE UNDER THE AGE OF 18 OR OTHER AGE OF LEGAL MAJORITY WHERE YOU ACCESS JIMI SERVICES, YOU REPRESENT THAT YOUR LEGAL GUARDIAN HAS READ, UNDERSTOOD, AND AGREED TO THIS AGREEMENT. FOR PARENTS AND GUARDIANS: YOU SHOULD NEVER LET MINORS IN YOUR CUSTODY TO USE ANY OF JIMI SERVICES WHILE UNSUPERVISED. PLEASE ENSURE THAT THE MINORS UNDER YOUR CUSTODY DO NOT GIVE OUT TOO MUCH PERSONAL INFORMATION, AND THAT THEY UNDERSTAND HOW TO USE THE SERVICES SAFELY. IN REGISTERING FOR AN ACCOUNT (DEFINED AS BELOW), YOU AGREE TO MONITOR THE ACCOUNT TO RESTRICT ANY USE BY MINORS. YOU ACCEPT FULL RESPONSIBILITY FOR ANY USE OF OUR SERVICES BY MINORS, AND THIS INCLUDES ANY USE OF YOUR CREDIT CARDS OR OTHER PAYMENT OR SETTLEMENT INSTRUMENTS OR DEVICES BY MINORS.

THIS AGREEMENT CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN THE SECTION TITLED “DISPUTE RESOLUTION.” THIS AFFECTS YOUR RIGHTS WITH RESPECT TO ANY “DISPUTE” BETWEEN YOU AND JIMI AND MAY REQUIRE YOU TO RESOLVE DISPUTES IN BINDING, INDIVIDUAL ARBITRATION, AND NOT IN COURT. PLEASE READ THIS ENTIRE AGREEMENT, INCLUDING THAT PROVISION, CAREFULLY.

This Agreement is fully committed to implementing and comply with applicable privacy laws and regulations, including but not limited to the Personal Data Protection Act 2012 of Singapore (“PDPA”) in order to inform you of your choices and our practices regarding any personal information you provide to us. Your use of JIMI Services involves the collection and use of your personal information. It is important for you to understand how this happens and how you may control it. If there is any place which you do not understand, please refer to JIMI Privacy Policy or contact customer service.

1. Introduction

1) This Agreement shall be the general terms and conditions that shall apply to you when you accept the products and services of JIMI. Therefore, please read this Agreement carefully before using the services provided by us.

2) JIMI reserves the right to amend, modify or revise this Agreement at any time. We may inform you of these amendments by showing the updated Agreement in JIMI Services, on our websites or sending you emails. YOU UNDERSTAND AND AGREE THAT IF YOU CONTINUE TO USE JIMI SERVICES, IT SHALL BE DEEMED THAT YOU AGREE TO THE AMENDMENT MADE BY US TO THIS AGREEMENT. IF YOU DO NOT AGREE TO THE MODIFICATION MADE BY JIMI, YOU HAVE THE RIGHT TO STOP USING THE PRODUCTS AND SERVICES PROVIDED BY US.

3) We may offer access to third-party mobile or desktop applications,websites or other services available in or through JIMI Services (collectively “Third-Party Services”), which are designed by third-party publishers (“Third-Party Publishers”). You understand and agree that access to, and use of, any Third-Party Services shall be subject to terms and conditions of use were provided by the Third-Party Publisher of such Third-Party Application, which may be shown in Third-Party Services or their websites.

2. Statement Of Intellectual Property and Ownership

1) JIMI is the owner or licensee of all right, title, and interest (including but not limited to copyrights, trademark rights, patent rights, trade secrets and other intellectual property rights) in and to all JIMI Services. All the components of JIMI Services, especially game products are owned or licensed by JIMI, including but not limited to the images, play method, visual components, narrations, characters, material and music of the game, word expression and the combination thereof, icons, charts, color combination, interface design, layout frame, all data and communications generated by, or occurring through JIMI, all moral rights that relate to JIMI Services, all the rights to create derivative works, etc.

2) Without prior lawful authorization by JIMI, you shall not modify, copy, disseminate, transmit, display, distribute, authorize, prepare derivative works of or sell any content, including but not limited to artwork, music, software codes, technology information, materials and others, except the reasonable use (such as for personal study, research or appreciation) permitted by laws and regulations. Should you fail to comply with the above provisions of this Article, JIMI shall terminate providing products and services to you without prejudice to the rights of other parties concerned, and you shall destroy all above-mentioned services or product content obtained.

3) JIMI shall obtain the ownership over any data information (including but not limited to account information, Game Data and system derived data. Game Data refers to various data contents that are generated in the process of your using the game or receiving game service and are recorded by the server or other platforms, including game log, security log and other data.) generated in the course of your use of JIMI Services. You shall only have the right to use such data and information in connection with such product in accordance with the Agreement and other rules as shown in JIMI Services. JIMI shall not be obligated to provide you or display data and information other than that you can acquire by logging in and using the products.

4) All the rights and interests under the game account in the service provided by JIMI shall be owned by JIMI. The rights and interests under various game accounts in JIMI Services, including but not limited to game coins or coupons, props (including equipment), etc., are part of JIMI Services, and their ownership belongs to JIMI. You can only use JIMI Services in accordance with the legal provisions and service rules. As mentioned in this Agreement, your “exchange/transfer of game props or interests” (if any) refers to the exchange/transfer of the right to use the game items and related interests, and you have no right to exchange/transfer the ownership of the game items and related interests.

3. Account and Password

1) You may be required to register or or update an account in JIMI Services (the “Account”). To create such Account, you must provide JIMI with accurate and up to date information that is personal to you, such as your name, address, phone number, and email address (“Personal Information”). Additionally, in order to play certain games or use certain features, you may also be required to provide JIMI with payment information (such as credit card information). Our retention and/or use of your Personal Information is subject to JIMI Privacy Policy. You shall be obligated to keep your account and password safe. You shall bear the loss resulting in loss of account and password, JIMI will not be liable for any loss of you.

2) Subject to the laws of your country of residence, minor children may utilize an Account established or play a game installed by their parents or legal guardian upon the parent/guardian’s acceptance of this Agreement. In the event that you permit your minor child or legal ward (collectively, your “Child”) to use an Account or other JIMI Services (including any Game), you hereby agree to this Agreement on behalf of yourself and your Child, and you understand and agree that you will be responsible for all uses of the Account or other JIMI Services by your Child whether or not any particular use was authorized by you.

3) JIMI has the right to review whether the identity information provided by your registration is true and valid by itself or through third-party services, and should actively take reasonable measures such as technology and management to ensure the security and effectiveness of your Account. You have the obligation to keep properly and use the Account number and password correctly and safely. If you fail to fulfill the above obligations, resulting in the loss of account password or account theft, and cause damage to yourself, you shall bear the direct and indirect losses arising therefrom. Including, but not limited to, the following circumstances:

a. If your account is lost due to technical obstacles or theft, and you have not fully proved that the loss or theft of your account password was caused by our willful intent or gross negligence, JIMI will not bear the loss caused by the recovery of the stolen account.

b. JIMI recovered the stolen account but does not guarantee the security and integrity of all the items in the account.

c. After the items in the stolen account are legally obtained by other users once or more times, JIMI does not bear the loss caused by not being recovered.

4) You should provide complete, detailed and true Personal Information at the time of registration. If the information provided is changed in the future, you should log in your account in time or contact us through our published contact information for update and modification. If you need to modify the personal identity information or account password provided after you register with your real identity, JIMI shall provide you with the service in a timely and effective manner in accordance with this Agreement and the relevant service rules of JIMI. If the personal information you provide to JIMI is inconsistent with the facts, JIMI has the right to stop providing products and services to you. When you claim the right to use an account to JIMI, if the account’s identity information record in JIMI is inconsistent with your identity information, JIMI has the right to refuse your request.

5) The Account is only the identification and certificate for you to log in and use JIMI Services in accordance with this Agreement. The ownership of the Account belongs to JIMI, and you can only use the Account according to the service rules. In the absence of sufficient evidence to the contrary, the right to use your Account belongs to the registrant. Without our permission, you shall not buy, sell, gave, exchange, inherit or in any other way trade the right to use the Account. You shall not disclose or provide the account number, password, or the identification information of the account registrant to others, nor shall you lend or transfer the account to others for use. If your account number or password is leaked due to your own fault or your computer infection with a virus or Trojan horse, you shall bear the loss caused thereby. JIMI (including but not limited to the website and forum management personnel, customer service personnel, etc.) will not ask your password in any way, so you should not leak your password, do not share the same account with others, do not install illegal or unauthorized programs. If you lose your password, we reserve the right to claim additional fees for this service.

6) If you find that your Account or password has been illegally used by others or there is abnormal use of the situation, you should immediately notify JIMI in accordance with the processing announced by JIMI, and have the right to notify JIMI to suspend the login and use of the account. However, you should fulfill the necessary formalities when applying such suspension, such as providing the personal valid identity information that is consistent with the identification information of the Account. If JIMI verifies that the valid personal identification information provided by you is consistent with the registered identification information, we will take timely measures to suspend the login and use of your account in accordance with this Agreement. However, JIMI will not be liable for the instructions that have been executed on your Account before the Account is suspended. If you do not provide a valid personal identification document or if the valid personal identification document you provide is inconsistent with your registered identity information, JIMI reserves the right to refuse your request.

7) JIMI has the right to temporarily freeze your account in the event of an anomaly in the server data or Account Data (includes user account or game character, game packs, vouchers, coupons, game props, game equipment, game currency, Personal Information and other date related to the Account). JIMI has the right to take appropriate measures to deal with the data, and such measures include, but are not limited to, restoring the data of the Account to the original state prior to the occurrence of the anomaly (including, but are not limited to, recovering the transferred data from the third party, deducting the content of the game package, the vouchers in the account, the coupons, the game props, the game equipment and the game coins), deleting the game account, or any other measures that JIMI believes to be reasonable, or restoring the data of the server to a certain point in time. The aforementioned anomalies include, but are not limited to:

a. abnormalities occur due to program bugs, version update defects, third-party virus attacks, or any other factors;

b. the use of illegal means or through other third parties without the authorization of the JIMI recharge led to account anomalies;

c. the Account user and real-name authentication information does not match, which resulting in account anomalies or disputes over ownership;

d. Accounts with Malicious Refunds (including but are not limited to obtains value-added services such as game packs, vouchers, in-game props, resources, equipment, etc. by recharging, and then refunds the money on his/her own without notifying JIMI of the deduction of the corresponding account resources through JIMI published customer service contact information);

e. other circumstances in which the User violates this Agreement.

8) You fully understand and agree that:

a. The provision of virtual value-added services to you is a commercial activity, and you have the right to decide on your own whether or not to pay the fees (including but not limited to the purchase of game packs, vouchers, coupons, the right to use virtual props in the game, and the acceptance of other value-added services, etc.) and the fee schedule of the third party authorized by JIMI to provide virtual value-added services to you, in order to obtain the corresponding virtual value-added services. If you do not pay the corresponding fees, you will not be able to obtain the corresponding services.

b. Changes or adjustments to fees and charges are normal business practices, and you may not seek compensation or reimbursement from JIMI for such changes or adjustments.

c. If any of the virtual goods and value-added services provided in JIMI Services have a special indication or description of the period or number of times they can be used, the period and number of times they can be used shall be subject to the description, and JIMI reserves the right to take measures to limit or stop the use of the aforementioned virtual goods and value-added services, or to withdraw them from you at any time without further notice to you.

d. If you use legal tender to purchase gift packs, redeem game props or other value-added services through JIMI Services, such game props, gift packs or other value-added services purchased or redeemed by you will not be refunded or exchanged for legal tender, unless otherwise provided by law.

4. License of Software

1) Your use of the game or receipt of JIMI Services shall be required to download and install the game software. You may obtain the game software directly from the official website operated by JIMI or from the third party authorized by JIMI. If you obtain the game or the game with the same title from the third party which has not been authorized by JIMI, it shall be deemed that you are not authorized by JIMI. JIMI cannot guarantee that the game can be used normally. Any and all losses caused thereby shall be borne by you solely LIABILITY.

2) JIMI may have developed different software versions for different terminal equipment or operating systems, including but not limited to Windows, iOS, Android and other multiple application versions. You should choose to download the appropriate version for installation according to the actual situation, after downloading the installation program, you need to follow the steps prompted by the program to install correctly. YOU FULLY UNDERSTAND AND AGREE THAT THERE MAY BE NON-INTEROPERABILITY BETWEEN DIFFERENT OPERATING SYSTEMS, WHICH MAY RESULT IN THE USER'S RECHARGE AND GAME DATA IN A CERTAIN OPERATING SYSTEM CAN NOT BE SMOOTHLY TRANSFERRED TO ANOTHER OPERATING SYSTEM. THE RISK OF LOSS OF TOP-UPS AND GAME DATA CAUSED BY SWITCHING BETWEEN DIFFERENT OPERATING SYSTEMS SHALL BE BORNE BY THE USER, AND JIMI SHALL NOT BE HELD LIABLE FOR SUCH LOSS.

3) Subject to your acceptance of all of the terms and conditions of this Agreement, JIMI grants you a personal, limited, revocable, non-exclusive, non-transferable and non sublicensable right to install and use the JIMI Services on devices you legally own or control, solely for your personal entertainment and non-commercial purpose (the “License”). The rights granted to you above are subject to the terms of this Agreement and you may make use of the License only if you comply with all applicable terms. The License becomes effective on the date that you accept this Agreement. All rights not expressly granted to you herein are reserved by JIMI.

4) The license granted to you by JIMI under this Agreement shall be directed at personal use. If you need to use our Game Software and Game Service beyond the scope of personal use or for any business purpose of Ho, you shall contact JIMI and obtain separate written authorization. Any act of installation, use, access, display, operation or commercial use without the permission of JIMI shall be deemed as infringement.

5) In order to ensure the security and functionality of JIMI Services, JIMI reserves the right to update JIMI Services or to change or limit the functionality of parts of JIMI Services without special notice to you.

6) Older versions of the software may not be available after the release of a new version of the software. If you need to use a new version of the game, please check and download the latest version of the software at any time.

5. User Behavior Regulation

1) You may post or upload content necessary for the use of JIMI Services under an Account with legal right to use, but you may not use JIMI Services to send or disseminate inappropriate information or content that violates the national laws and regulations, including but not limited to the following content:

a. spreading obscenity, pornography, gambling, violence, murder, terror or abetting crimes;

b. insulting or defaming others or infringing on their legitimate rights and interests;

c. infringement of the intellectual property rights or other rights of a third party;

d. any defamation of persons, sexual harassment, racial discrimination, or adverse influence on minors;

e. vulgar expressions, coarse language, abusive behavior, verbal harassment, either towards JIMI or other users;

f. contain viruses, Trojan horses, etc., which may cause harm to or affect the stability of our or anyone else’s computer system;

g. any software, documentation and other content which, in the reasonable judgment of JIMI, is inappropriate or which JIMI has not approved;

h. containing other contents prohibited by laws and administrative regulations.

2) If you do not agree with this Agreement or the related service rules, or do not accept the modifications made to this Agreement or the service rules from time to time by JIMI, you may stop using JIMI Services at any time. If you choose to stop using JIMI Services, you will be deemed to have abandoned all rights and interests in your Account and the corresponding game props in your Account, and JIMI will not be liable for any of your obligations or responsibilities.

3) You shall equip yourself with all computer and network equipment and network resources necessary for the registration and use of JIMI Services, and shall bear the costs of accessing the Internet on your own.

4) You are obliged to keep the identity information and documents related to the use of the Account and JIMI Services. You have the right and responsibility for the behavior generated by the account after logging in, and the person who uses the account is regarded as yourself, and any behavior made by him/her will be regarded as your behavior, and you should be responsible for all the behaviors of the users of this Account.

5) In the course of your use of the JIMI Services, you are prohibited to:

a. use JIMI Services for any unlawful purpose;

b. modify, reverse engineer, reverse compile, reverse assemble, reproduce or transmit JIMI Services, nor may you modify any proprietary communication protocols used by JIMI Services, modify or lock the information in dynamic random access memory;

c. engage in any abnormal use behavior (including but not limited to damaging or attacking the server or overloading the server, etc.) that may affect JIMI Services;

d. use plug-in programs or game modification programs;

e. use JIMI Services through or with the aid of third-party software that has not been approved by JIMI;

f. engage in any behavior that breaks the rules of the service or violates the fairness of the game;

g. engage in any behavior that involves trading game props or otherwise profiting from the JIMI Services, including but not limited to:

(i) registering multiple game accounts and/or game character IDs, conducting gaming behavior for profit, and using JIMI Services;

(ii) sell the virtual goods such as game props or physical rewards obtained through single or series of outputs in the gameplay of JIMI Services for a profit.;

(iii) take advantage of the difference in the value of game props on different servers and trade game props on different servers for profit;

(iv) acting as an intermediary in the transaction of virtual goods or value-added services within a game account, game props or other products to collect fees for profit;

(v) trading user accounts, virtual goods or value-added services for profit on trading platforms that are not provided or endorsed by JIMI;

(vi) use the game props obtained from JIMI Services for profit instead of focusing on the improvement of your own character strength;

(vii) use of JIMI Services to organize or participate in gambling, implement or participate in the implementation of theft of other people's property or game props and other suspected illegal and criminal acts;

(viii) any other in-game profit-making behavior that is not aimed at the normal entertainment needs of JIMI Services.

h. use abnormal methods to log in JIMI Services (including but not limited to the use of third-party software or systems that are not developed, authorized or approved by JIMI to log in the game), use invalid credit cards, the theft of other people's credit cards and other means (commonly known as the “Black Card”) for recharging

i. use of network gas pedals and other plug-in software, or robotic programs, and other malicious methods, destroy service facilities or disrupt normal service order;

j. create, distribute or use plug-ins, blockers, acceleration software and other kinds of cheating programs, or organize or abet others to use such software programs, or sell such software programs to gain financial benefits for individuals or organizations;

k. use any means or methods to attempt to attack the relevant servers, routers, switches, and other equipment used to provide game service for the purpose of unlawfully obtaining or modifying unauthorized data or information, or for the purpose of interfering with the normal game service, or for any other harmful purpose;

l. take advantage of technical defects or loopholes that may exist in the online game system to make profits for yourself and others in various forms (including but not limited to duplicating game props in the game) or engaging in other improper behaviors;

m. use any of intellectual property rights of us to create or provide the same or similar network services, such as emulated servers, private servers, etc., without our written permission;

n. use JIMI Services to perform any act that may adversely affect the normal operation of the Internet or that may interfere with the normal use by others of JIMI Services;

o. use JIMI Services for any other purpose that is detrimental to JIMI;

p. use JIMI Services to engage in illegal shouting or operations, including but not limited to sending or disseminating third-party URLs or game trading platforms, induce other users to search for third-party game platforms, third-party trading information, proxy training, proxy recharge and other information not approved by JIMI;

q. obtain the rights and interests in the game (including but not limited to game coins, game props, etc.) in an irregular manner such as violating the service rules;

6) If you become aware of any unauthorized use of your account or any breach of security of your account, you should immediately notify JIMI.

7) You may only exchange or transfer your rights and interests (including, but not limited to, game currency, game equipment, etc.) under your game account through the built-in exchange channels (if any) of the game and third party trading platforms (if any) officially recognized by JIMI. Transactions of game props on trading platforms not approved by JIMI will not be recognized or protected by JIMI. Any disputes arising from such transactions shall be resolved by you. You may not exchange game accounts, characters, game props, etc., with real money or real goods without the permission of JIMI, otherwise we will consider you to have unconditionally given up the service you used to exchange them. In case of such behavior, JIMI reserves the right to suspend or terminate the provision of services to you without any liability.

8) When your account is suspected of illegal and unlawful behavior such as number theft or plug-ins, you shall cooperate with JIMI, answer questions raised by JIMI regarding the use of JIMI Services in order to safeguard your own legal rights and interests. You agree to use the monitoring data in the product program as the basis for determining whether your Account is pirated, whether there is any cheating in the game through the use of plug-ins and other methods, as well as other violations.

9) You agree that, under an obligation of confidentiality, JIMI is only obliged to provide such evidence to any judicial or administrative authorities that require us to provide you with evidence of suspected piracy, the use of plug-ins or any other violation of law that JIMI considers to be a violation of the law, in accordance with the legal procedures. JIMI is not obliged to present such evidence to you.

10) JIMI can provide the service of recovering stolen items according to your application, but based on the characteristics of software products, JIMI does not make any express or implied promises about the results of the recovery, and you need to read the recovery instructions, submit the relevant materials, and bear the relevant consequences in accordance with our requirements.

6. Limitation, Suspension or Termination of Services

1) If you engage in any one or more of the following behaviors or under the following circumstances, JIMI has the right to delete your account or terminate or suspend all or part of JIMI Services to you (including but not limited to blocking all or part of the account under your name and prohibiting the relevant character from logging in), and has the right to cancel or recover the undue benefits that you have gained from the violation in JIMI Services:

a. abuse rights;

b. provide false registration information;

c. JIMI believes, in its sole discretion, that your account is at high risk of being stolen;

d. conduct behavior that harms the legitimate rights and interests of JIMI and its related right holders, affiliates, partners or other right holders;

e. violate this Agreement or other service rules issued by JIMI or have used JIMI Services through improper means;

f. In addition to the above, if you have committed any other misconduct while using JIMI Services.

2) You agree that if you are found to be in violation of this Agreement through monitoring by us or reporting by a third party, We have the right to take necessary measures in accordance with the severity of the violation, including but not limited to: blocking or deleting your uploaded information; deducting the game props, game currency or other resources in the Account; resetting your Account nickname or avatar; restricting your Account log-in or restricting your in-game activities; temporarily or permanently banning your Account; other related measures.

3) If one or more of the accounts registered with the same identity information violates this Agreement, JIMI reserves the right to cancel the account or suspend or terminate the services of the account according to the actual situation.

4) JIMI may terminate JIMI Services in accordance with the actual situation and announce announce it in advance according to laws and regulations. If JIMI Services are terminated for any reason, you shall take appropriate measures to deal with the rights and interests under the Account by yourself, including but not limited to canceling or stopping the use of the Account, game props and so on.

5) Unless otherwise compelled by law, JIMI shall not be liable for any form of compensation or indemnification as a result of the termination of JIMI Services, including but not limited to compensation for the fact that you are no longer able to continue to use the game account, game props and so on.

6) You understand and agree that the duration of use of any game currency, game props or services provided by JIMI shall not be construed as being indefinite, but shall be construed as ending on the date on which JIMI announces the termination of the network service or the loss of game data due to a technical failure. The term of use shall not be interpreted as never ending, but shall be understood as ending on the day of termination of the service or the date of loss of game data due to a technical failure.

7) You shall refrain from involving JIMI in political and public events through the use of the game services provided by JIMI. JIMI reserves the right to suspend or terminate its services to you.

7. Interruption of Services

In the event of any of the following circumstances, even without notice, JIMI reserves the right to discontinue the service provided without any liability to you:

You can check the daily downtime for maintenance on the official website of us or in the product announcements;

2) failure, malfunction or negligence of the software and hardware equipment of the partner or telecommunication network system;

3) hacks into the our network, tampered with, deleted or falsified or fabricated data on the website, or have committed any act that affects the normal operation of the our computer system;

4) Force Majeure reasons;

5) other reasons based on the requirements of government departments, laws or national policies.

8. Beta and Experimental Services

All information within the test service and the experience service is not under the custody of services. By logging in to the test service or the experience service and using the game services of the test service or the experience service, you voluntarily accept the following terms and conditions:

10. Legal Liability

1) You shall comply with the relevant local laws and regulations and respect local public order and good customs in the process of using the game service provided by JIMI. If you act in violation of local laws and regulations, legal public order or good customs, you shall bear the LIABILITY independently.

2) You shall agree to protect and safeguard the interests of JIMI and other users. If any damage or loss is caused to JIMI, other users of JIMI or other third parties as a result of your violation of the relevant laws and regulations or any terms and conditions of this Agreement, you agree to bear the legal liabilities (including but not limited to civil, administrative or criminal liabilities) and compensate for all the losses incurred, which include direct economic losses, loss of reputation or goodwill, and compensation paid to JIMI and other consequential losses.

3) You shall indemnify us, our subsidiaries, affiliates, employees and all other related personnel against any damages and indemnification liability arising from your violation of relevant laws and regulations or this Agreement.

11. Disclaimer of Warranties

1) WE DOES NOT GUARANTEE THE COMMERCIAL REPUTATION OF THIRD PARTIES AND THE AUTHENTICITY, VALIDITY AND LEGALITY OF THE SERVICES THEY PROVIDE THROUGH LINKS AND LABELS ON JIMI SERVICES AND OTHER RELATED NETWORKS. YOU SHOULD MAKE YOUR OWN INDEPENDENT JUDGMENT TO VIEW OR CLICK ON THEM. IN THE PROCESS OF USING THE GAME SERVICE, YOU MAY JUMP TO THE WEBSITE, APP OR OTHER SERVICES PROVIDED BY THIRD-PARTY PUBLISHERS (INCLUDING BUT NOT LIMITED TO PAYPAL, WEPAY, ALIPAY AND OTHER PAYMENT CHANNELS), WHICH ARE PROVIDED BY THIRD-PARTY PUBLISHERS INDEPENDENTLY. 3) TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JIMI DOES NOT WARRANT THAT JIMI SERVICES WILL MEET YOUR REQUIREMENTS, THAT THE SERVICES PROVIDED WILL BE UNINTERRUPTED, OR THAT THEY WILL BE TIMELY, SECURE, ERROR-FREE, OR THAT INFORMATION WILL BE TRANSMITTED ACCURATELY, TIMELY, OR SMOOTHLY.

4) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JIMI WILL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR CLAIMS ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF JIMI SERVICES.

5) JIMI IS ONLY RESPONSIBLE FOR THE RESPONSIBILITIES AND SCOPE SET FORTH IN THIS AGREEMENT. THE FAILURE OF JIMI TO PROVIDE JIMI SERVICES AS A RESULT OF GOVERNMENTAL ACTION, LAWS AND REGULATIONS, OR NEW OR CHANGED DECREES, POLICIES OR OTHER FORCE MAJEURE BY THE RELEVANT STATE AUTHORITIES SHALL NOT BE DEEMED A BREACH OF CONTRACT BY JIMI.

12. Termination of Agreement

1) JIMI reserves the right to terminate this Agreement at any time for any reason, or for no reason, with or without notice to you. For purposes of explanation and not limitation, most Account suspensions and terminations are the result of violations of this Agreement. In case of minor violations of these rules, JIMI may provide you with a prior warning and/or suspend your use of the Account due to your non-compliance prior to terminating the Agreement or modifying or deleting an Account.

2) In the event of a termination of this Agreement, any right you may have had to any pre-purchased game access or virtual goods, such as digital cards, currency, weapons, armor, wearable items, skins, sprays, pets, mounts, etc., are forfeit, and you agree and acknowledge that you are not entitled to any refund for any amounts which were pre-paid on your Account prior to any termination of this Agreement. In addition, you will not be able to use JIMI Services. The Dispute Resolution provisions of this Agreement will survive termination and apply to all Disputes that arose or could have been initiated prior to termination.

13. Dispute Resolution

This Agreement and any action related thereto will be governed by the laws of Singapore without regard to its conflict of law’s provisions. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English.

14. Notices and Contact

1) The notices under this Agreement may be given by key page announcement, email, mobile phone short message, message sending on the user side of the products. Such notices are deemed to have been served to the recipient on the date they are sent.

15. General

1) JIMI reserves the right to modify, add to, delete or update this Agreement.

2) This Agreement consists of the terms of this Agreement and the service rules published by JIMI from time to time. If any service rule has terms that the this Agreement is not agreed upon or if there are conflicts and ambiguities with other separate rules, the special agreement of each rule shall prevail. JIMI has the right to amend this Agreement or publish new rules based on business development needs, you continue to agree to use is considered to be the recognition of the new rules.

3) Based on the business development and other reasons, the relevant products or services of JIMI may be operated by different affiliates, and it may be necessary to transfer the rights and obligations under this Agreement among the affiliates or to a third party. We will notify you of such transfer in the manner as agreed in this Agreement at that time.

4) If any article in this Agreement becomes or becomes invalid or unenforceable in whole or in part for any reason attributable to, the remainder of this Agreement shall remain in full force and effect and be binding upon the parties hereunder.
